ICMR Bill for Regulating Infertility Clinics in India

PRLog (Press Release) - Jul. 13, 2012 - The Indian Council of Medical Research (ICMR) has prepared a Bill which will make it mandatory for the clinics involved in reproductive procedures to get registered in the country’s maiden National Registry of Art clinics. This Assisted Reproductive Technology Regulation Bill will encompass all the clinics who are involved in infertility treatments through procedures like artificial insemination with husband’s semen (AIH) or in-vitro fertilization embryo transfer (IVF).

The main motive behind introducing such a Bill is to control the exponential growth of infertility clinics in the country so as to safeguard the interest of the public in terms of their medical, social and legal rights. At present, anyone can open infertility or ART clinic in India as no permission is required. This act has come up with various conditions which the clinics have to abide by in order to practice infertility treatments. Considering the medical and social implications, these conditions have been set by ICMR so that more infertile couples can enjoy being parents of healthier children.

According to the Bill, all clinics will require a registration number which they will receive only after they meet the minimum requirements set by the ICMR. "All ART clinics will now be checked for whether they are complying with the ART Bill regulations and the authenticity of their treatments. It will become mandatory to register with the ART registry once the Bill is cleared by Parliament.", said the ICMR officials.

The Bill further states that only woman between the age group of 21 to 35 can act as a surrogate mother and she cannot give birth to more than five lives including her own children. If a surrogate mother is married, in such case the consent of the spouse is mandatory. Moreover, it is also stated that no ART bank or clinic can send an Indian citizen for surrogacy abroad.
