HOA’s Home Owners May Be Sued in Civil Action Cases

Davie, FL – Commercial and Real Estate Attorneys Neal R. Kalis and M. Scott Kleiman of the Law Firm KALIS & KLEIMAN warns that when a Home Owner Association (HOA) is sued, individual homeowner could end up paying for damages and legal fees by way of “special assessments.”

A case being closely watched now is the Trayvon Martin case, where a young man was fatally shot during a confrontation with a neighborhood watchman at the Retreat at Twin Lakes, a gated townhouse community. If watchman George Zimmerman is charged and convicted of killing Trayvon Martin, Trayvon’s family could sue the HOA and homeowners for the way the neighborhood watch program was established and operated. While the investigation is on-going, it highlights the importance that HOAs should review their rules and regulations to ensure compliance and to protect their homeowners.
