March 26, 2012 - PRLog -- March 26, 2012, Atlanta, Georgia -- A major decision is before the United States District Court for the Southern District of Florida to determine whether agencies of the United States Government are above the law.  In Brennan v. Atkinson [12-20131], the District Court is reviewing what some are considering an open and shut case in favor of Brennan.  The challenge is the perception that could fall on federal agencies as a result.  
    Brennan has revealed a clear violation of the Privacy Act and the United States Constitution where federal officers failed to comply with federal policy.  Seemingly, their only defense is that "We are the Government therefore we can break the law."  The amazing part is that I bet that the average American reader woke up this morning under the impression that he or she was still in the United States of America where the United States Constitution was still effective and equally applicable.  
    In this case, the Government has suggested that they will not acknowledge the indisputable evidence presented by Brennan, the rule of default does not apply to them, and they may randomly restructure Brennan's complaint under oath to whatever form or fashion that they deem appropriate for the purpose of surviving scrutiny and without recourse.  
    Brennan has introduced evidence from another government agency that unquestionably impeaches administrative decisions of the defendant that have adversely affected him.  The District Court has been entrusted to make this very important decision.  To be or not to be just?   Today, that is the question.
