Bayer Settles Some Yaz/Yasmin Claims

PRLog (Press Release) - Mar. 20, 2012 - Bayer Healthcare reported that it settled approximately 70 YAZ/Yasmin claims wherein plaintiffs allege that the birth control pills caused serious injuries of which Bayer knew, or should have known, and failed to warn. [1]  YAZ/Yasmin have been linked to blood clots, pulmonary embolisms, deep vein thrombosis and stroke.  “This is a good start and just the beginning of what will hopefully lead to a global resolution of the litigation,” commented Holly Ennis of Ennis & Ennis, P.A.

In addition to the allegation of the failure to warn, these lawsuits also allege that Bayer company officials wrongfully touted Yaz to be just a safe as other birth control pills and promoted the drug for uses not approved by the U.S. Food and Drug Administration (FDA). [2]

All cases pending in U.S. federal courts have been consolidated in a multidistrict litigation (MDL) proceeding for common pre-trial management.  In December 2011 the MDL court stayed the first case set for trial and ordered the parties to participate in a mediation process.  This, in turn, led to the settlement of some claims, without the admission of liability.  

Bayer further reported that it will continue to consider the option of settling individual lawsuits in the U.S. on a case-by-case basis. [3]
