Attorney Hector A. Pena was interviewed on Actualidad Miami 1020 today Thursday 9, 2012. Attorney Pena explained that he filed a lawsuit on behalf of his client a Home Health Care clinic challenging the constitutionality of Florida statute 400.471. Specifically, Attorney Pena explained that only Miami-Dade County was affected by the statute and that no other county in the state is affected by the statute.
The statutory interpretation at issue, has the potential to affect over 750 business in Miami-Dade county and potentially cause thousands of individuals local jobs. Mr. Pena has long been a consumer advocate in the community. In summation he feels the legislature has acted unconstitutionally against Miami-Dade county and it's citizens and business, in essence targeting the law to only apply in Miami-Dade county bypassing constitutional protections for such legislative endeavors. “It is a sad day when deals are made in Tallahassee that affect us in our backyard without even having the opportunity to know what's going on”, states Mr. Pena.
