On October 25, 2004, the IRS issued a consumer alert advising taxpayers to beware of anyone claiming settlement of tax debts for "pennies on the dollar" through what is called the Offer in Compromise Program.
A very high percentage of all Offers in Compromise filed in the U.S. are rejected by the IRS. This is because most Offers in Compromise are filed by “tax resolution” companies who make these empty promises in television commercials without even knowing the details of the potential client’s problem.
The Law Offices of Nick Nemeth, PLLC wants to announce that regardless of the seemingly high rejection rate, the program is still alive and well.
“Recently, a client came to us with an IRS debt of over $100,000. He was facing the possibilities of wage levies, bank levies and seizures,” said Nemeth. “Within 11 short months, we had finalized an Offer and had settled his case for one-hundred dollars.”
Although this outcome cannot be guaranteed in every case, the difference between retaining a law firm and a non-lawyer tax resolution company is that no empty promises are made.
“Our firm will not file an Offer in Compromise simply for delay tactics or because an empty promise was made,” said Nemeth. “We will diligently do our research and thoroughly investigate the facts and will only apply for this program if we feel the client is a good candidate.”
