Divorce Rate of Older Americans (Baby Boomers) On The Increase

Davie, FL – While the overall divorce (http://www.kaliskleiman.com/Divorce_and_Family_Law) rate in the United States has declined, a study by the National Center for Family & Marriage Research at Bowling Green University in Ohio (http://ncfmr.bgsu.edu/) shows that aging baby boomers are driving the divorce rate among older adults. Approximately one in four people getting a divorce is over the age of 50 and this number is expected to increase.

According to an article in the Orlando Sentinel (http://articles.orlandosentinel.com/2011-12-14/features/os-elder-divorce-20111214_1_divorce-rate-baby-boomers-aging), one reason for the increase is the stress and life changes associated with retirement. “Good marriages survive that retirement transition. Bad marriages can be made worse. If one or both of the spouses experienced divorce in the past, they are more at risk to divorce later in life,” said Susan L. Brown, co-director of the National Center for Family & Marriage Research at Bowling Green University in Ohio. “The divorce rate for aging boomers is twice as high for those who were previously divorced than those who were on their first marriage.”

No matter what your age or situation, when going through a divorce or dealing with complicated family law matters, it is important to hire an attorney and law firm that is well-qualified, compassionate and understands the difficult challenges you face and who can guide you through them.

Older adults going through divorce may need assistance in getting a divorce (support and separation without divorce), alimony and spousal support, and assistance with post nuptial agreements. While older, one may still need to address issues of child custody and child support, including visitation, modifications and enforcement; child relocation; adoption; and dependency laws.

According to an AARP blog (http://blog.aarp.org/2011/12/15/the-takeaway-boomers-driv...), later-life divorce brings financial complications, with estate and inheritance (http://www.kaliskleiman.com/Probate_Wills_and_Trusts) concerns, Medicare and Social Security issues, and division of retirement savings to consider. Divorce can be financially devastating and there are also care giving questions raised by the prospect of older adults who don’t end up remarrying.
