Having achieved this, Claudia is now not only the sole Isle of Wight Solicitor who is a Chartered Tax Adviser but also one of the first Solicitors in the country to have acquired the standard as well as the advance STEP diploma.
The advance STEP diploma focused on the issue of trusts and in particular trust disputes – how they arise, how they can be managed and, most importantly, how trusts should be set up and managed for such to be avoided in the first instance.
The concept of trusts is unique to the English (and Commonwealth)
Trusts are particularly helpful when it comes to mitigation of taxes and most importantly Inheritance Tax liabilities. Trusts are also invaluable to help protect assets from residential care fees. Similarly trusts can be used to protect assets for the benefit of vulnerable beneficiaries such as children, persons with a disability or someone who is going through a bankruptcy or divorce. Special Trusts can also be created to avoid loss of valuable means tested benefits following receipt of compensation for a criminal or personal injury claim.
Trust law is a specialist area of law with many potential pitfalls. Much litigation and issues have arisen in recent years as a result of non-experts setting up and running trusts. To combat these issues STEP has brought out the Advance diploma to provide practitioners dealing with trusts with the requisite level of knowledge, expertise and skill.
