The mother also had a history of depression and was supposedly on a cocktail of prescription medications to treat her physical and mental disorders. The mother didn’t truly have a home to offer her child, nor did she have her own automobile, both of which the father could provide to his daughter. Furthermore, the mother had not complied with a court order to get drug tested, until a full year after she was ordered to provide a hair sample.

The mother had displayed confusing, belligerent and combative behavior at the court proceedings, while the father appeared to be reasonable and willing to do whatever it takes to care for his daughter. After examining all the evidence, the family court awarded sole residential, legal and physical custody of the child to her father while allowing court supervised visitation for the mother on a weekly basis.

In child custody cases, the court will do it’s best to determine which parent is better suited based on the best interests of the child.
