Oklahoma Battles Tribe-Owned Payday Companies

Native American payday loan businesses operate under sovereign immunity protection, issued by the federal government. Oklahoma is concerned that this immunity will allow these companies to operate on dishonest grounds.

PRLog (Press Release) - Oct. 31, 2011 - Payday loan companies have met opposition in Oklahoma, where many in the industry are owned by Native American tribes which operate under the cloak of sovereign immunity. The state government is finding it hard to regulate these independent industries and is at a loss as to what to do.

Oklahoma has established a set of regulations concerning payday loans. These include a loan limit at $500, and an interest rate cap at $65.

Unfortunately, it is hard to regulate these laws when it comes to internet based companies which operate under the cloak of sovereign immunity. Nine instances in the last year were not resolved concerning this issue. There is a danger that state regulation laws will become meaningless due to this serious loophole.

The General Counsel for the Oklahoma Department of Consumer Credit states that this is a difficult situation to remedy. There’s not much that can be done, but action needs to be taken.

These tribal owned online payday loan companies are able to get away with extreme amounts of dishonesty because of their federal rights. They cannot be tried in court for their actions.

The Consumer Federation of America is also concerned about the issue. There is no way to monitor these companies and keep them from taking advantage of vulnerable Oklahoma citizens. Because of this, the tribal owned companies exceed limits, tag on extraordinary fees, allow customers to roll over their loans for years at a time, and catch customers into cycles of debt for their own personal gain.

Many of the lenders who operate these unreliable businesses are steering clear of any contact with authorities. One company in Tulsa refuses to answer phone calls from any government agency.

The Executive Director of the Native American Fair Commerce Coalition is ambitious to see improvements in the tribal payday lending industry. He says that he hopes that it will work out and put all storefront operators out of business.

While one must be cautious, payday loans can be a great benefit to men and women who are in need of a little extra cash to help them make it until their next payday. These loans often last a brief two to four weeks. Payday loans are an excellent way to remedy a financial emergency, and avoid overdraft fees at banks.
