In Riverside County’s San Jacinto corruption case, Firetag wrote a dismissal motion that eventually resulted in a number of charges being thrown out. Subsequently, seven out of nine defendants entered into plea deals with the prosecution.
Of the nine men, one man in particular was moved by the outcome. James Duncan Hawkins Jr., a 37-year-old Fontana man was facing a third-strike conviction that would have sent him to prison for the rest of his life.
Pending the final case decisions, Hawkins had already made one attempt on his life but fortunately he failed. He claimed that if he was convicted of a third strike, he would have made another suicide attempt in order to avoid prison.
Hawkins was facing charges for a late-night home burglary and assault in Murrieta after an arrest for evading law enforcement in his vehicle. According to Hawkins, Firetag challenged every part of his case, including whether or not he was in fact fleeing an officer inside his car.
Hawkins was uncertain of the outcome, he even thought there might be a hung jury; however, the jury kept coming back with not guilty verdicts, one after another until they finally said, “guilty.” Hawkins looked at Firetag when he grabbed his hand and smiled saying, “Don’t worry, it’s a misdemeanor.”
Hawkins is more than happy with the case results, he now has his job back, he is attending church and he is discussing the possibility of marriage with his girlfriend. In an interview that occurred prior to Hawkins’s trial Firetag said: “If the prosecution is zealous and has high standards, then I think it’s just as right for the defense to have that as well.”
