Fixed Fee Application for a Divorce Financial Settlement

Oct. 26, 2011 - PRLog -- Stephensons' family law solicitors are delighted to be able to offer low cost fixed fee packages for divorcing clients who are involved in Court proceedings to resolve the division of their marital assets. Being involved in any Court application can bring a number of uncertainties, not least the question of ‘how much will this cost?’

Following on from the success of our other fixed price legal services; we are pleased to be able to offer a fixed cost service to clients who wish to make an application or have to respond to an application for a financial settlement.

Our fixed fee packages are available for divorcing clients who qualify for the service and who have total assets for division between them of up to £350,000 (including pensions).

For ease and simplicity, the packages available are split into 3 stages. Our solicitor fees for each stage are £2,500 plus VAT of £500 making a total for each stage of £3,000. This fixed amount is what clients pay for our costs at each stage.

There are occasions when there may be additional costs which a client may wish to incur, and these are not included in the fixed fee price. For example our fixed packages do not include expenses that may be charged by other professionals to help a client’s case. If other professionals are needed and are important to the case then those additional expenses will be agreed with our client prior to any involvement. This gives clients control over how much money they wish to spend on their case.

The final stage of an application to Court for a financial settlement is the Final Hearing itself. Very few divorcing couples who start the Court process reach this stage. If this hearing is necessary it is because it has not been possible to reach an agreement within the process. The vast majority of Court applications settle with an agreement without the need for a Final Hearing.

A Final Hearing is essentially a couple asking the Court/a District Judge, to make a decision about how their assets should be divided. The hearing involves the couple giving evidence and answering questions put to them. The Judge having heard that evidence and having read all of the evidence prepared within the case will make a final and binding decision regarding the division of the assets.

Stephensons are able to offer a further fixed fee package for representation at that Final Hearing. Again this will provide a cost effective solution to representation and can be agreed with the solicitor dealing with the case in advance of the hearing. Going to that Final Hearing knowing the costs of representation can only help with financial management and take away the stress of costs uncertainty.

How do you pay?

We ask our clients to pay the fixed fee in full for each stage they purchase. This can be achieved either by full payment at the beginning of each stage or two simple instalments during the stage. If a client chooses to pay by our instalment option then one payment of £1,500 will be made at the beginning of the stage and the second payment of £1,500 will be made one month thereafter. We believe that this simple and uncomplicated management of costs enables our clients to be able to concentrate on their case without the worry of how their case is to be funded.
