FREE help for employers to manage redundancy
“Employers are falling foul of the New Fair Work Act when managing redundancies - because they rely on their knowledge of how they managed redundancies in the past”, said Bridget Hogg, Principal Consultant of Adelaide’s outplacement firm - HR Development at Work. As the economy dips again, more employers are considering restructuring and redundancies. Some are not aware that the way they managed redundancies in the past may contradict new Fair Work Act laws.

“All modern awards contain a clause requiring employers to consult with employees before implementing major business change that will have a “significant effect” on employees” says Margaret Kaukas, Senior Associate, Donaldson Walsh Lawyers. “The Fair Work Act provides that a failure to comply with an obligation in a modern award (such as a failure to consult prior to redundancy) will mean the termination will not be considered a "genuine redundancy", and therefore will be subject to unfair dismissal laws” – even when only one redundancy is involved.
