Miami Judge Certifies Class in David J. Stern Case

Miami Judge Certifies Class in David J. Stern Case

Fort Lauderdale, FL – U.S. District Judge Ursula Ungaro has certified a class action law suit today involving foreclosure attorney David J. Stern for violations of federal labor laws by his former employees. The final ruling came after a review and detailed report was submitted by a Federal Magistrate who recommended that class action status be granted to the former employees.

David J. Stern and his affiliated business grew to be one of the Florida’s largest foreclosure practices; before being investigated by Florida’s Attorney General for allegations of fabricating documents, slipshod paperwork and questionable fees. Stern’s actions caused him to lose his largest clients (major financial institutions) and also lead to the layoff of about 80% of his 1,200 employees.

“These employees didn't do anything wrong," said attorney Steven R. Jaffe of Farmer, Jaffe, Weissing, Edwards, Fistos & Lehrman, who he and co-counsel are representing approximately 700 former employees. "They were hard workers, showing up on time, doing their jobs and they were unceremoniously cut loose simply because David Stern decided he didn't need them anymore because his profits were down."

The class action suit charges that Stern's law firm and its publicly traded processing unit DJSP Enterprises did not follow the Worker Adjustment and Retraining Notification Act or WARN Act requirement to give employees 60 days' warning, including wages, salary, commissions, bonuses, accrued holiday pay, accrued vacation pay, pension and 401(k) contributions, continuation of health insurance coverage and other benefits which would have been paid or covered during the notice period, before a mass layoff.

“What these employees endured was unfair,” added Jaffe. “We are very pleased with the ruling and that the case is moving forward.”
