Washington Court Grant’s Co-Participant’s Motion to Dismiss in Assumption of Risk Case

A federal judge from the Eastern District Washington has granted summary judgment to a motocross enthusiast, who was sued after his bike struck and killed a 12-year-old boy on a motocross track in March of 2007.

 
PRLog - Sep. 7, 2011 - Austin, TX- September 7, 2011- The latest Sports Litigation Alert reports that a federal judge from the Eastern District Washington has granted summary judgment to a motocross enthusiast, who was sued after his bike struck and killed a 12-year-old boy on a motocross track in March of 2007.

The court found that the victim, who was represented in court by his family, was aware of the risk and that the defendant was not reckless or did not intentionally try to collide with the boy.

The most recent issue of Sports Litigation Alert also includes the following summaries;
•   A federal judge from the Eastern District of Michigan has dismissed with prejudice the claim of a student athlete who alleged that his Fourteenth Amendment right to due process was violated in October 2007 when he was informed he was no longer eligible to play football at Saginaw Valley State University.

•   A federal judge from the Eastern District of Michigan has granted Central Michigan University’s motion for judgment on the pleadings in a case in which two student athletes sued the school for violation of Title VI of the 1964 Civil Rights Act, Title IV of the Educational Amendments Act of 1972, and the Equal Protection Clause of the Fourteenth Amendment.
