The U.S. Supreme Court issued new rules with ERISA provisions for misrepresentations regarding benefit plan changes. Plan sponsors and administrators should take a look at their communications protocols to ensure steps are taken to provide accurate and complete information to plan participants and beneficiaries.

The Ninth Circuit's decision expanded the scope of potential liability in benefits claims under ERISA. This will entitle the beneficiaries of an employee benefits plan to sue parties other than the plan administrator to recover benefits due under the plan.
