McCumber Daniels Presents at FLCC on Topic of Punitive Damages Defense

June 9, 2011 - PRLog -- Mark Hartig, shareholder at McCumber, Daniels, Buntz, Hartig & Puig, P.A., presented on the topic of ‘Defending Against Claimant’s Motions to Amend to Add Punitive Damages’ to attendees of the Florida Liability Claims Conference (FLCC) co-hosted by the Florida Defense Lawyers Association.  

Plaintiff attorneys look to amend their causes of action to add claims for punitive damages to exact maximum pressure against individual defendants and corporations by opening them up to financial worth discovery.  This presentation focused on defending against such claims by exploring strategies for attacking plaintiff’s written proffer, to arguing against the amendment at hearing.  The presentation included the background of Florida Statute § 768.72 including the purpose of punitive damages and punitive conduct.  The presentation also discussed the plaintiff’s proffer of evidence: what it must contain and when it must be served, discovery strategy, how to draft the Memorandum in Opposition and establishing the necessity for a hearing.  Finally, Mr. Hartig provided the audience with hearing strategies in defending motions to add claims for punitive damages.
