Battle for Bailey Could Have Been Forgone For a Fiver

As the media spotlight centres on a sausage dog, the outcome in the ‘Battle for Bailey’ will be decided as the four month struggle by his former owners to get him back in their care culminates in a court case on Thursday 2nd June.

June 1, 2011 - PRLog -- Anticipated to cost both parties hundreds, if not thousands of pounds, the dispute, which has also seen the end of a friendship, could have been avoided if the former owners, the Rowlinsons, or the current owner, Mr Spencer, had spent as little as £5 on a legally binding Agreement for the sale of the dog.

The document, which is available for £5 from LEGAL365.com, sets out the terms and conditions of sale for a dog or puppy, requiring signatures from both the seller and buyer.

Simon Stell, managing director of LEGAL365.com comments: “Whilst this case is slightly more unusual because the owners gave the dog away as apposed to selling him, hundreds of pets are sold every year without so much as a handwritten receipt as proof of purchase. This leaves both the seller and the buyer wide open to a range of repercussions should either have a change of circumstance or, as in Bailey’s case, a change of heart.

“With an Agreement the seller confirms details of the dog’s health, vaccination history and eligibility for the UK Pet Passport scheme, whilst the buyer promises to care for the dog and to obtain a similar promise from any future owner. This promise is enforceable by the RSPCA (or equivalent) should they choose to do so.

“The Agreement only takes a matter of minutes to complete online and enables peace of mind for both parties, avoiding any issues from arising in the future. If either of Bailey’s owners had opted to complete an Agreement, they could have saved themselves a lot of unnecessary time, stress and heartache.”
