The Florida Highway Patrol trooper was stationary on the side of the road when a blue car came by him at what was described as a high rate of speed. The trooper determined that the driver was driving above the posted speed limit and was able to determine his speed at 115 mph by using his dual stalker radar. However, the trooper could not identify the driver or the type of vehicle, which he described to be a Dodge Neon with a fin on the back. The trooper pulled out to follow the vehicle and watched this blue vehicle pass another car in a no-passing zone. The trooper radioed his dispatch and put out a be on the lookout (BOLO) for a blue car with a fin, possibly a neon. Approximately 45 minutes later, a deputy in a nearby county in Florida stopped a blue BMW with a fin and called the trooper to respond to the scene. The trooper responded to the scene and believed that was the same vehicle, issuing the driver Florida speeding ticket for 115 mph in a 60 mph zone and a ticket for illegal passing. Because Florida has a law that requires a mandatory court appearance for any speeding ticket above 30 mph over the posted speed limit, the client hired David Haenel to fight the ticket for him in court. After requesting the radio transmissions and BOLO from the Florida Highway Patrol, Mr. Haenel was very prepared to fight the issue of driver identification with the trooper. Following a non-jury trial, the Judge sided with Mr. Haenel and found the driver not guilty of the speeding ticket and improper passing. The driver was saved a probable license suspension, minimum $1000 fine, points, and probable traffic school.
