In November 2010 we obtained a positive judgement in favour of our clients from the courts of Spain for a deposit that was paid for the construction of a property. Our clients, a British couple, paid a deposit of €54,023.87 to the construction company PROMAGA SAU for an apartment on the Residential Complex Vistahermosa 4 in La Linea de la Concepcion. The amount paid on account was guaranteed by a bank guarantee from the BANESTO bank and delivery was estimated to be April 2007. The purchase agreement provided for completion of the works 24 months from the startomg date. October 2008 was the final delivery date allowing for a period of grace of 3 months. On February 17th 2009, given that our clients had not received the occupation licence from the developer, the contract was terminated and we were instructed to act for our clients to recover the funds paid. On November 10th 2010 the Court of the 1st Instance in La Linea de la Concepcion ruled in favour of our client and ordered PROMAGA SAU and BANESTO to refund both the amount deposited of €54,023,97 plus interest.
