ROC Now: Reports George Boley Sr. trial hits snag

Two key government witnesses in the deportation case against Clarkson resident George Boley Sr. — alleged by federal officials to be a war criminal — have been blocked from entry into the U.S. because of their violence during the Liberian civil war, according to Boley’s attorney.

Federal immigration lawyers wanted the witnesses to testify at Boley’s trial, scheduled to resume Feb. 28 at the federal immigration detention center in Batavia.

Boley’s trial began in Batavia in September. The two witnesses — Sonny Swen and Blamo Tuan — testified via video from Africa against Boley, but the technology presented such problems that the judge halted continued use of video. He did not allow their testimony to be used and decided any witnesses from Africa would have to testify in Batavia.

Immigration lawyers then decided to bring the witnesses to the U.S. for the resumption of Boley’s trial in February, according to Boley’s Buffalo-based lawyer, Matthew Kolken.

Immigration officials refused to comment on the pending case against Boley.

In September, the witnesses acknowledged their own crimes during testimony. Tuan admitted that he had killed babies during the civil war.

Ironically, top officials with the federal Immigration and Customs Enforcement, or ICE, are the ones preventing the testimony against Boley, Kolken said.
