On March 11, 2008, the defendant and plaintiff were both in the left-hand lane of Interstate 205 heading south, with the defendant driving directly behind the plaintiff. Traffic slowed to a stop as southbound drivers rubbernecked at an Oregon car accident across the freeway in the northbound lanes. The plaintiff stopped, due to the stopped traffic in front of him, but the defendant failed to do so, hitting the plaintiff’s motor vehicle from behind and pushing the motor vehicle forward into other stopped vehicles. The Oregon car collision resulted in property damage to the plaintiff’s 2004 Volvo.
Farmers Insurance paid for the Volvo’s repairs, but the plaintiff claimed that the value of the motor vehicle was reduced. Farmers Insurance offered a sum of money, but the decrease in the value of the Volvo was more. Since the case was filed under ORS 20.080, the defendant was required to pay the plaintiff for the diminished value of the motor vehicle. Farmers Insurance was therefore forced to pay for the plaintiff’s attorney fees, which meant the plaintiff was able to keep his compensation from the defendant for the Volvo’s decline in value.
