Aug. 6, 2010 - PRLog -- Deciding on divorce proceedings or receiving notice of divorce proceedings presents a difficult event for everyone involved. The impact is not only emotional, but also affects domestic arrangements and has financial implications. When there are children involved it can be so much harder.

Mace & Jones are there to help you navigate these difficult times. Whether you are taking the first steps by considering what a divorce or separation involves or if you have already received a notice of divorce proceedings and need to know what happens next, we can give you the advice and support with as little distress as possible.

Divorce or separation proceedings can be expensive and in difficult times such as these, spiralling solicitor’s fees are the last thing you want to think about. Mace & Jones understands this and so we offer a fixed-fee divorce service for £350 + VAT, excluding court fees.

Our fixed fee divorce service covers all the standard divorce proceedings, which is normally an administrative process, as long as the spouse being divorced does not mount a defence. Firstly, we file a petition at court describing the details of the marriage and any children involved as well as the reason why you are filing for divorce. A number of other documents need to be filled out at the same time. The court then issues the petition and sends it to your spouse, who then responds and states whether they will be defending the divorce. If not, the case follows a "special procedure".

The next stage is for the petitioner to file an affidavit in court, which includes further details, such as whether reconciliation was attempted. The petitioner also files a formal request to the court for a divorce. A district judge looks over the documents and if approved certifies that the case proceed to a decree nisi. A degree nisi is the penultimate stage of the divorce and gives a final six weeks for any objections to the divorce to be filed. If a clear six weeks passes the petitioner can apply for the degree nisi to be made absolute, which finalises the divorce.

The fixed fee service includes all the advice and assistance you need to go through this entire process.

Mace & Jones are a member of Resolution, a family law association that works to promote a none-confrontational approach to divorce proceedings. We recommend that a civil approach be used to maintain constructive dialogue. Our experience has shown that this is preferable to pursuing a court settlement.
