Imposing Sanction Against Arizona Business

The beginning of ethnic cleansing is always through laws and policies similar to that which governor jan brewer has put in place and this must be stopped by imposing sanctions against arizona businesses.

Arizona Governor Jan Brewer must be arrested for ethnic cleansing. She signed laws through which to convert Arizona into a State with rich white men who can vote for her to keep her in power. An exodus of Hispanics from Arizona is on the rise since the laws were signed.

Given that Senator John McCain is no longer campaigning as a presidential candidate, he no longer needs Hispanic votes. McCain, a hypocrite favors ethnic cleansing legislation. Sadly, the Republican Party has refused to take Congressional action as well.
In Zimbabwe, Robert Mugabe by legislation seized land from the white farmers for the benefit of black population. Ethnic cleansing in Bosnia and Herzegovina resulted in the government sanctioning of the mass exodus of non-Serbs. The beginning of ethnic cleansing is always through laws and policies similar to that which Governor Jan Brewer has put in place in Arizona.

As reported - A Secure Europe In “A Better World =European Security Strategy (Brussels, 12 December 2003)” www.consilium.europa.ed/ue/docs/cms-data/docs/press/data/en/reports states in relevant part in its introduction (hereinafter “ESS”)
“As a Union of 25 States with over 450 million people producing a quarter of the World’s Gross National Product (GNP), and with a wide range of instruments at its disposal, the European Union is inevitability a global player.” Being a global player, the European Union has the duty to take appropriate action against the State of Arizona and the Governor for ethnic cleansing.

The strategic objectives to the report read in part:
“We live in a world that holds brighter prospects but also greater threats than we have known. The future will depend partly on our actions. We need both to think globally and to act locally.”

The EU, now must think globally, act locally as to Arizona because the conduct of Governor Brewer is a threat to the Union and clearly  “in an era of globalization distant threats may be as those that are near at hand.

The impact of ethnic cleansing in Arizona will affect the EU. “The first line of defense “requires action by the EU. “Our security and prosperity increasingly depend on an effective multilateral system. We are committed to upholding and developing International Law” (“ESS “An Effective Order Based on Effective Multilateralism”) “The quality of international society depends on the quality of the governments that are its foundation.” (ID)
When ethnic cleansing occurs and a specific race or group is targeted especially by legislative action just because people in power wish to remain in office they create a “cultural, social and political crisis, and the alienation of young people.”

Jan Brewer by legislative action to win upcoming election is displacing people. Those displaced are more likely to engage in organized crime. Per ESS “A number of countries have placed themselves outside the bounds of international society.” Similarly, Arizona by legislative action targeting Hispanics has placed itself “outside the bounds of international society.”

“Those who are unwilling to do so should understand that there is a price to be paid, including on their relationship with the European Union” (ESS). The ESS asks the Union to be “More active in pursuing our strategic objectives. This applies to the full spectrum of instruments for crisis management--- we need to develop a strategic culture that fosters early, rapid, and when necessary, robust intervention” Because “Preventative engagement can avoid more serious problems in the future.  An EU which takes greater responsibility and which is more active will be on which carries greater political weight” (ESS).

As ethnic cleansing is against International Laws, the Union must impose sanctions against Arizona by cutting off its economic resources. By economic resources cut off, the Governor and those are helping her will rethink their position.

The Grand Chamber of the Court of Justice in Joined Cases C-402/05P and C-415/05P Kadi and A1-Barakaa (2008) ECR I- 6351) rendered its judgment on September 3, 2008. Smart sanctions imposed by the European Union based upon United Nations Security Council resolutions against individuals and groups associated with the fallen regime and those who were believed to be providing terrorism financing. The purpose was to cut-off total financial resources.

In its decision the Kadi Court stated:

“In its relations with the wider world, the Union shall uphold and promote its values and contribute to the protection of its citizens. It shall contribute to peace, security, the sustainable development of the Earth, solidarity and mutual respect among peoples, free and fair trade, eradication of poverty and the protection of the human right --- as well as the strict observance and development of international law.”

Per Court Of Justice (COJ) threats to international peace and fight against terrorism is an objective of general interest so fundamental to the international community. The Court Of First Instance stated  “Just as economic or financial sanctions may be directed specifically at the rulers of a third country, rather than at the country as such, they may be directed at person or entities associated with those rulers---- wherever they maybe .” The listed business entities provide growth to the economy of the State of Arizona.

Without economic support, Jan Brewer can not continue to engage in this conduct.
In Kadi, the COJ stated:

“As the Commission has rightly pointed out,  Articles 60EC and 301EC would not provide an efficient means of applying pressure to the rulers with influence over the policy of a third country if the community could not, on the basis of those provisions, adopt measures against individuals who, --- are sufficiency connected to the regimen against which the sanctions are directed.”

As long as businesses contribute to Arizona’s economy, neither Governor Brewer nor the State has incentives to change.

In responding to the Irish Supreme Court the COJ stated in Case C-84/95 Bosphorus Hava Yollari:

“Any measure imposing sanctions has, by definition, consequences which affect the right to property and the freedom to pursue a trade or business, thereby causing harm to person who is in no way responsible for the situation which led to the adoption of the sanctions.”

The importance of the aims pursued by the sanctions regimen is to justify negative consequences of a substantial nature to these Arizona Business entities. By contributing to Arizona’s economy, they have assisted the State to engage in ethnic cleansing. Their option would be to leave Arizona to avoid any sanctions.

The European Security Strategy requires the European Union and the Community to ban all trades with these businesses. Additional sanction, travel; investments; and education involving Arizona must be subjected to sanctions. Ethnic cleansing is wrong and is truly contrary to the Democratic progression of the United States.
