Fitness Industry Seizes Alternate Music Solutions In Response To ppca Copyright Tribunal Ruling

Despite the recent announcement of the ruling by the Copyright Tribunal to substantially increase copyright fees for the use of music in group exercise classes, solutions are already rife and readily available for the fitness industry.

May 20, 2010 - PRLog -- The ruling that was officially announced on 17 May, dictates that in a typical fitness centre, the current license fee charged by the Phonographic Performance Company of Australia (PPCA) to use original music in group fitness classes, will be increased by around 1,500 per cent, from 96.8 cents per class – with an annual maximum capped fee of $2,654 – to now being either $15 per class (a flat fee) or $1 per class attendee, and with no maximum cap available.

The good news is that the unwavering industry unity that was created during the years spent fighting the case is now being utilised to create solutions to help fitness facilities avoid having to pay the exorbitant fee increase. For example, music providers – such as Trax Music (www.traxmusic.com.au) – which specialise in producing music for use in group fitness classes, took proactive action in the months leading up to the decision announcement, creating extensive ranges of PPCA-free music for use in all manner of group exercise classes, from step to hilo, indoor cycling to Pilates, and every class in between.

In anticipation of a fee increase, industry heavyweights such as Les Mills Asia Pacific (which licenses the largest brand of pre-choreographed group exercises classes in Australia, and contributed over $250,000 to fight the case on behalf of its licensees) and Fitness First (with around 100 clubs nationwide) took the initiative to introduce these PPCA-free solutions into their existing programs and facilities prior to the announcement being made. And it will only be a matter of time before other health clubs follow these industry leaders in a bid to preserve their own businesses.

So, although the ruling was considered a disappointing blow to the industry, solutions to overcome the fee increases are already available and being utilised by many of the key fitness industry stakeholders across Australia. And any fitness business has access to solutions such as those offered by Trax Music and the like.
