Former Telcordia and PalmSource Patents Pursue Apple, RIM, Samsung, and More

SmartPhone Technologies LLC. filed a complaint of patent infringement against several large corporations including RIM, Samsung, Apple and others.

March 4, 2010 - PRLog -- SmartPhone Technologies, LLC. a company based in Frisco, Texas filed a complaint Wednesday, March 3, 2010 against Research in Motion Corp., Samsung, Sanyo, LG, Motorola, Apple, Pantech, Insight, and AT&T. SmartPhone Technologies, LLC. is claiming infringement on seven patents, related to networking or hardware of mobile phones, that were originally assigned to Telcordia and PalmSource. All of the patents except 5,742,905 were originally assigned to PalmSource now known as ACCESS Systems of America, Inc. ACCESS is primarily known for developing the Palm OS system which runs on approximately 40 million devices that have been sold since 1996.

U.S. Patent 5, 742,905, titled “Personal Communications Internetworking” was originally assigned to Bell Communications Research, now known as Telcordia Technologies. The patent was filed in September 1994.  In an independent report by Patent Calls, mobile phone service providers are named as the most probable infringers of the patent however, the report notes that pager and personal digital assistant manufacturers could be possible infringers as well. The patent is of fundamental importance and has 859 forward patent citations, according to patenttools.com

SmartPhone Technologies, LLC. named specific phones for each corporation in their complaint, the most popular being the Apple iPhone, Motorola DROID, and RIM’s Curve 8520.  

SmartPhone Technologies, LLC. is claiming the listed corporations as, “Regularly doing or soliciting business, engaging in others persistent causes of conduct, and/or deriving substantial revenue from goods and services provided to person”, and is asking the court apply a permanent injunction as well as pay damages, cost and expenses with interest.

When Patent Calls tried to reach SmartPhone Technologies, LLC. for comment, we were told they do not and have never resided at the address given in their complaint. SmartPhone Technologies, LLC. could not be reached for comment.

Besides the complaint from SmartPhone Technologies, LLC., Apple has its own litigation to deal with. They filed a patent infringement complaint against HTC earlier this week in the Delaware District Court, claiming 20 patent infringements.

Patent Calls tried to reach all defendants named in the complaint for comment; RIM, AT&T, and Motorola all had no comment. The remaining defendants were not reached by press time.

SmartPhone Technologies, LLC. is not to be confused with Smartphones Technologies, Inc., based in Jacksonville, Florida. The two companies are in no way affiliated. Smartphones Technologies, Inc. was founded in 2002 and is a leading mobile phone application publisher. They work with brands such as the iPhone, Blackberry, and Palm Pre.
