BURDEN OF PROOF IS NOT REQUIRED – In Arizona, to win a consumer fraud case, the Attorney General does not have to prove that anyone was actually harmed. The Attorney General does not have to prove that a company intended to do anything wrong. It does not matter if the company can prove that they had the best intentions and that no one was harmed.

PERFORMING STANDARD BUSINESS PRACTICES CAN BE SUBJECTED TO INCORRECT SCRUTINY - Harvest Properties through the direction of Colin Reilly carefully explained the “subject to” process to Sellers when their properties were purchased. This is a standard and legal practice, but was still questioned by the Attorney General. Additionally, If the Seller had no other person willing to sign for them under a Power of Attorney (POA), Harvest Properties found a party related to the company to sign for them, an act that is legally permissible. Regardless of being legal and specifically authorized by the Seller, the Attorney General declared this to be "Consumer Fraud".

PERFORMED LEGAL ACTIONS AS ADVISTED BY LEGAL COUNCIL MAY NOT BE PROTECTIVE - Colin Reilly through Harvest Properties exercised many legal practices, including the use of Blank Documents and Trusts to ensure his seller’s were treated with respect and could exercise their legal rights in selling their home. Colin was determined to create an environment of seller awareness to ensure a fair transaction. Despite the fact that Blank Documents and Trusts are legal and  were done under the advice of the attorney for Harvest Properties, the Attorney General declared it to be "Consumer Fraud".

Colin Reilly through Harvest Properties took many steps that ultimately led to settlement of no wrongdoing. Many of the actions Colin exercised were not required, but he executed standard practices to ensure a strong ethical reputation for him and his company based in Tucson, Arizona.
