R v CHAMBERS revealed the fact that cases involving confiscation arising from illegal tobacco importation have been decided on the wrong law i.e. based upon old regulations. As a result HM Customs are now reviewing up to 4000 cases which may well have resulted in wrong sentences. Campaigner, journalist and legal adviser Milton Firman is leading the way in the campaign for compensation and said today:
" This is a shambles. Peoples' lives have been ruined as a result of them being wrongly penalised and heavily fined. Only the actual importer was ever liable for the duty under the new regulations.."
Firman adds:
"It is absolutely vital that anyone who was fined since about 2001 should come forward now as they may well be entitled to substantial compensation."
