A Surety Bail Bond is the commercial alternative to paying full cash to the court.   This process involves a contractual undertaking guaranteed by  a Surety   company which has adequate assets to satisfy the full face value of the bond if it were deemed that it should be paid. The bail bond agent guarantees the court that he will pay the full amount of the bond if a defendant fails to appear for any of their scheduled court appearances. The bail agent’s guarantee is made through a surety company and/or by pledging property owned by the bail agent.

For this service, the defendant is charged a non refundable premium (10% of the bail amount in Utah). An example would like this: Let's say the bail amount is $10,000.00, the premium charged would be $1,000.00. In most cases the bail bond company is contacted by the defendant or one of his friends or relatives and the arrangements are made.  Usually  the person signing for the bond has his/her credit ran to show that they have the financial wherewithall to pay the bail bondsman in case the defendant fails to appear in court.

After this procedure is completed, the bail agent will post a bond for the full bail amount, financially guaranteeing the defendant’s return to court as scheduled.

With money on the line, the bail agent has a financial interest in supervising the defendant, and ensuring that he/she appears in court each end every time the court orders them to appear. If the defendant fails to appear in court (FTA), the bail bond agent has a short time to find the defendant and bring him/her to court.  If the defendant is returned to court before the allotted time has expired the bail agent is free from the bond.  The co-signer will incur fees for the expenses incurred by the bail agent in locating the defendant.  This is a basic overview of how a bail bond works.
