Where’s the credit?
Borrowers who default on their mortgage payments suffer a “credit hit” because the lender(s) report late payments on the consumer’s credit reports. Many lenders require borrowers to be in default on their mortgage in order to consider a loan modification, short sale, short refinance, or deed in lieu. Most borrowers do not know that when they default on their mortgage, their other credit freezes up. Home equity lines of credit as well as credit card limits are reduced if not completely closed.
Consequently, the consumer’s credit score plunges downward with each reported late payment on their mortgage. Ironically many lenders will not speak with borrowers until they are at least three months delinquent. What can a borrower do in order to protect their credit rating?
If a borrower begins with a Mortgage Audit on their loan(s) first, then files a Qualified Written Request with the lender(s) it then becomes illegal for a lender to report the borrower delinquent if they do not pay their mortgage. If the lender does report late payments, there are monetary damages due the borrower. Furthermore, the lender(s) must remove the reported late payments.
