Effective July 1, 2009, Governor Ritter signed Senate Bill 09-080 into law that allows rural homes to harvest rainwater for ordinary household purposes, fire protection, the watering of poultry, domestic animals and livestock on farms or ranches, and the limited irrigation of gardens and lawns.
One of the major driving forces for an exemption to these long-standing water rights laws is based on studies from 2007 showing that 97% of rainwater evaporates or is soaked up by plants before it ever reaches a river or aquifer. Since this rainwater is not contributing to Colorado’s water supply, it is now legal to capture this water to use it under the guidelines of a well permit. It is important to note that the bill prohibits adding rainwater collection systems to homes that have municipal water supply available. With an average rainfall of 19.93 inches a year (in Boulder), a homeowner has the opportunity of harvesting a significant amount of rainwater per month.
