FT Myers - The defendant was arrested on charges of grand theft. The State filed a Criminal Court Complaint relating to a crime that occurred at a JC Penny’s store on December 19, 2008. The client was observed entering the fragrance department where an assortment of cologne had been selected, to then head towards the dressing rooms which had just been cleared of all merchandise and trash.
The client had entered one of the fitting rooms with an array of merchandise, however exited with only one article of merchandise in hand. The dressing room was then promptly searched and empty product packages had been discovered. The client had been approached by Loss Prevention where $316.00 in merchandise was recovered. The client was then placed under arrest for Retail Theft over $300.00 where a prison sentence could be faced of up to five years.
The client waived the Arraignment, requested a jury by trial and entered a plea of not guilty. However, it had been agreed that the State of Florida would be best served by granting the client the opportunity to enter into a Pre-Trial Diversion Program for a period of not less than six months.
The client had successfully completed the diversion program and the charge was Nolle Prossed (dismissed).
