Loopholes in the Canada immigration system at the Canadian high commission (CHC), New Delhi are taking a toll on applicants nowadays and testing their patience in every way possible. While there are many corrective measures that can be taken for a satisfying experience of applicants but CHC doesn’t seem to be interested in any improvements.
Employment reference letters
Reference letters is the most exasperating of the requirements at the CHC, New Delhi that causes most refusals. In fact, this requirement can almost be declared as an injustice towards the applicants, especially in the Indian context, as the employer issues reference letter that list responsibilities and duties fulfilled by the applicant in his current job, only if the employee has to leave the job. As a result, many employers are quite fussy about issuing the reference letter, in advance.
Somnath Chatterjee, a Ludhiana resident who wishes to settle in Canada to pursue his career further in Civil Engineering is sorely disappointed with the requirement that caused refusal of his visa application “My profile is apt in every way according to the current eligibility criteria for Canada Skilled Worker category but my employer, with whom I have been working for the past 10 years, refuses to provide me with the reference letter. What am I supposed to do now? It is not fair on the part of CHC to reject my application merely on the basis of my inability to produce reference letters. I wish an alternative is provided for the requirement, as soon as possible”
Knowing well about this problem faced by the applicants, CHC, New Delhi still turns a blind eye to it and constantly refuses cases if the applicant is unable to produce reference letters from their employer.
The requirement for reference letters is a part of the second stage of the application process, after the initial approval from the centralized case management center at Nova Scotia, Canada. So, if the applicant is unable to fulfill the requirement for reference letter, the processing fee submitted by them is non-refundable.
Discrepancy in the dispatch process and submission deadlines
This is followed by delay in dispatch and receipt of communication from the CHC that gives less time to applicants to arrange necessary documents and comply with all formalities in time. Dispatch of the communication letter takes around 5-15 days from the CHC and the receipt of the letter by the applicant takes another 5-15 days. However, the deadline for submission of documents is counted from the date of the letter and not when the applicant receives it.
Timely update of information in records of the applicants
Extensive delay in update of applicant’s records is another problem that causes great hassle to applicants filing for Canada immigration. Not making timely updates in contact information or documents provided by the applicants, many times causes communication letters being sent to wrong addresses leading to confusion.
What are the solutions?
CHC, New Delhi thereby needs an immediate attention from higher authorities to look into the given problems and sort them at the earliest. “Alternative options must be provided for applicants who fail to produce reference letter from their current employer, instead of an outright refusal of the case,” says, Ajay Sharma, Principal immigration consultant of Abhinav, a renowned visa consultancy firm in New Delhi. “Transparency in the mandatory requirement of the reference letters from day one or by including this requirement at the Nova Scotia stage is another way CHC, New Delhi can reduce the frustration of the applicants due to unnecessary wastage of their efforts, time and processing fee,” he adds further.
However, until these amendments are made by CHC, immigration consultants are surely good rescuers for such candidates, who rightfully advice people from the very start, not to apply if they cannot meet the requirement for reference letters. As regards, the communication letter delays, CHC can count the deadline for submission of documents from the date of receipt of letter by the applicant.
The given measures can easily be tackled with little efforts from higher officials at the CHC, New Delhi, only if they wish to reduce the grievances and be sensitive to the position of the applicant.
