Slutsky Family Files Civil Lawsuit Against Penndel, PA Daycare PA for Death of Son

Attorney Daniel S. Weinstock announced today that a civil lawsuit was filed July 21, 2009 on behalf of Mr. and Mrs. Slutsky for the wrongful death of their two-year-old son Daniel against the owner of a daycare center. The complaint says that Daniel was left locked and unattended in the back of a Toyota Sienna Minivan with the windows closed for more than six hours.  

According to the allegations in the Slutsky vs. Shvartsman, et al complaint, the daycare center owner, Rimma Shvartsman, forgot Daniel was in the back seat of her minivan on a day when it was more than 80 degrees.  By the time Daniel was discovered in the vehicle at the end of the day, the efforts to revive him were unsuccessful.  He was pronounced dead at Saint Mary's hospital upon arrival.

Mr. and Mrs. Slutsky have declined interviews, but have spoken through their attorneys Daniel S. Weinstock and Carolyn M. Chopko, both of the Philadelphia personal injury law firm Feldman, Shepherd, Wohlgelernter, Tanner, Weinstock & Dodig.  

Weinstock said, “Mr. and Mrs. Slutsky are absolutely shocked by what happened to their son, and are having an extremely difficult time moving on with their lives. They feel totally devastated and betrayed by Rimma Shvartsman, who was not only owner and operator of Fairy-Tales, Inc., but currently lives only two doors away from their home in Langhorne, Pennsylvania.”  Mrs. Slutsky commented through her attorneys, “In our society many women have to work either full-time or part-time; and if we cannot trust daycare caregivers and teachers, who can we trust then?”

According to Weinstock, “Mr. and Mrs. Slutsky are hoping their civil lawsuit will draw attention to some of the potential dangers of leaving children with daycare centers and encourage other parents to not take their children’s safety for granted.”

Weinstock says statistics suggest as many as 43 children died as a result of vehicular hyperthermia last year in the United States.  At the time of this press release, 19 children, including Daniel Slutsky, already died this year of hyperthermia after being left in the backseat of a car.  

“The most important thing Mr. and Mrs. Slutsky want the public to know is how important it is to ask the right questions and to investigate any daycare center before sending their children,” said Weinstock.
