FDA holds electronic cigarette shipment without authority! Wednesday, April 20, 2009 the Federal
Drug Administration Inspector on duty held an e cigarette shipment to Newbotix
The FDA claiming it needed a “medical device” registration number under it's CFR 21 (510K)
code requirement. FDA has not stated a legal “Authority”
Bill Hawk, product engineer at Newbotix claims that the controversial e cigarette is no more a
“medical device” than the tobacco cigarette is! If the FDA classifies the electronic cigarette as a “medical device”, then it must also classify the tobacco cigarette as a medical device!
The electronic “e cig” is an alternative to tobacco cigarettes, but has no health risk factors like
regular cigarettes. In fact, Newbotix markets e cigarettes as “Health e Cigarette”, a safe way
to quit smoking. Because e cigs do not have tobacco and does not burn, it is not subject to smoking bans.
Electronic cigarettes have a choice of nicotine levels from NONE to regular. They produce a
harmless water vapor just like entertainment type “fog machines” or your breath on a cold day.
