The intestacy rules create a trust over all of the property of someone who dies without writing a Will. This trust imposes particular duties and gives certain powers to the personal representatives (the ones appointed to manage the estate when someone dies). After the payment of debts the residuary estate will be shared amongst the family under the rules of distribution.
From February the statutory legacy for a spouse under the intestacy rules is changing.
