If the representative is convinced that the insured was responsible for the accident then he calculates the damages that had happened to the vehicle as well as to the personal injuries of the claimant. The claim is calculated on the basis of the medical bills, the loss of earnings and other expenses that are likely to arise in the future as a result of the auto accident. This helps the insurer to determine the claim amount that has to be paid.

The final step is the payment of the claim to the insured or to the claimant. However in case of dissatisfaction the claimant can seek legal justice. This also has some complications, because generally the claimant is required to pay one third of the damages as fees to the lawyer so it is better that he/she negotiate the fee with his lawyer. It is also important to consult a doctor in order to make sure that there are no health complications as a result of the accident.
