Misdemeanor Categories May Be Confusing

Misdemeanors are really not that serious, but nonetheless have numerous categories attached to the various crimes committed and classified as a misdemeanor.

Even though every state has their own individual definitions of what constitutes a misdemeanor, they are similar enough in each state to get a good idea of what is involved in committing one.

Misdemeanors are classified as Class A being the most serious with a jail term not exceeding a year plus a fine (variable from state to state.) Class B misdemeanors usually mean a jail sentence of less than 180 days. Class C misdemeanors only carry fines.

Felonies are more serious and include capital felonies such as first-degree murder. In jurisdictions with the death penalty, capital felonies may have either the death penalty or life in prison.

If the crime committed is murder, each jurisdiction may vary the penalty involved depending on a variety of circumstances. For instance if there was premeditation, or if the death was the result of a crime of passion different sentences may apply. If it's robbery and/or theft, it is sometimes classified based on the amount stolen and if deadly force was used while committing the crime.

Criminal defense lawyers typically use the defendant's upbringing as a mitigating factor during a trial. At times this may serve to lessen the sentence or move the offence from a higher class to a lower one.

In this area of criminal law, defense strategies often play a large part in the determination of the final sentence. Lawyers have been known to use scenarios such as the victim of the crime in question had previously harmed the defendant or the defendant's judgment was impaired – but it was not their fault their judgment was impaired.

On the other side of the fence, the prosecution is wont to offer evidence showing aggravating factors that would possibly move the crime up to a higher class. For instance, it could be shown the defendant used a deadly weapon while committing the crime or that the victim was a minor.

Other aggravating factors could include actions that are considered to be particularly depraved or heinous or that the defendant intended to commit sexual assault during a robbery etc.

The big picture is taken into account when working with offenders in this area of the law and at times like this, it's crucial to have a qualified criminal attorney to assist the accused through the justice system.
