Woman fined through DVLA error!

A woman has had to pay a fine simply because the DVLA lost her documents. This happened when she sold a car, got a car tax refund from the DVLA and then a fine from the DVLA for having no car tax!

Woman fined through DVLA error!

A woman has had to pay a fine simply because the DVLA lost her documents. This happened when she sold a car, got a car tax refund from the DVLA and then a fine from the DVLA for having no car tax!

It all started when a car was part exchanged, Anne Roberts signed the documents and also applied for a refund of the car tax that was left on the car, a friend who works at the DVLA put the documents in the internal mail. A few weeks later, she received a refund of the car tax and another few weeks later got a receipt stating that she was no longer the registered keeper of car.

But then a week later another letter arrives from DVLA informing her that she is being investigated for not having any car tax, and that she will be fined. Despite complaining by letter the DVLA were having none of it.

Ann Roberts said: "I couldn't go with him to the dealer so I signed the form and he took it up. However, he said afterwards that I'd signed the wrong part.

"I signed the right part and attached it to a form to get a refund from the road tax, and a friend who works at the DVLA took it in for me and put it in the internal mail."

"I contacted them about the lost document and they said I had to pay because I was still liable for the fine.

"Letters were exchanged back and forth, and the last letter I got from them was in August. It said the DVLA deals with millions of documents on a regular basis and they said some could be misplaced like in this case.

"I took that to be an admission that they'd lost my documents."

She has been told that she has to pay the £80 fine, it was £40 but that was only if it was paid straight away. However, if she leaves and it goes to court the fine could rise to a £1,000!

A spokesperson for the DVLA said: "The DVLA strives to provide an excellent service to its customers. We cannot comment on individual cases.

"Where a vehicle keeper fails to tax or SORN their vehicle, we issue a late licensing penalty.

"This is a proven system, which fundamentally relies on vehicle keepers to comply with their legal obligations to notify DVLA of all relevant changes.

"However, where vehicle keepers consider themselves not liable, they are asked to provide written evidence, which, if acceptable, will result in the case not being pursued."
